When you provide an Attestation to a User, it may be the case that, in order to provide such an Attestation, (a) you process a subject User’s data that is in your possession independent of SELF Products, and/or (b) you process User Data shared or otherwise disclosed to you by the subject User through SELF Products. You hereby acknowledge that, upon your successful Attestation, the User shall receive a Molecule and, notwithstanding any restrictions that may be in any terms of service you provide, and in addition to the license you grant to us under Section 4 (Licenses) of the Terms, the User will have certain use rights in the Molecule and you hereby grant to any such User a revocable, worldwide, exclusive, fully paid-up license (upon payment by said User of any fee associated with your Attestation) to use any Molecule generated by your Attestation provided said User remains in compliance your applicable terms of service.

Whether you provide an Attestation to a User is subject to your sole and absolute discretion. For example, you may refuse to provide such an Attestation where you have intellectual property, privacy, or regulatory concerns. SELF ID has no control over, responsibility concerning, or liability with respect to your decision to provide or deny an Attestation. Any Attestation you issue is at your sole risk.

It is solely your responsibility to ensure that Users to whom you issue an Attestation comply with your terms of service, including the license granted by you to Users under these Attester Terms. You acknowledge and agree that we have no obligation to monitor Users’ behavior with respect to their compliance with your terms of service, nor do we have any obligation regarding any such User’s compliance with your terms of service.

Throughout the term of your use of SELF Products, you are required to, and solely responsible for, drafting, updating, and maintaining your own terms and conditions that govern the relationship between you and other Users with respect to any Attestation you issue, services you offer, or products you provide (“Attester Agreement”). Further, your Attester Agreement shall be made available to Users in a manner consistent with industry standard practice and in compliance with applicable law (see Section 4 of these Attester Terms).

By using SELF Products, you agree to enter into a legally binding agreement with each User under your Attester Agreement, which shall govern all transactions, disputes, and relationships with said Users.

SELF ID provides the passive conduit through which you engage Users, but does not act as a party to any transactions, contracts, or agreements between you and Users with whom you enter into Engagements. You hereby acknowledge that SELF ID has no responsibility for the terms, execution, or enforcement of your Attester Agreement.

Without limiting any provision of the Terms, you hereby agree to indemnify, defend and hold SELF ID harmless from any claims, damages, losses, or liabilities arising from or related to your Attester Terms.

As set forth in Section 6 (User Obligations) of the Terms, it is solely your responsibility to ensure compliance with applicable laws and regulations. Further, and without limiting your compliance obligations under applicable laws and regulations or the Terms, you represent and warrant to us that you have in place the required know-your-business (“KYB”) and know-your-customer (“KYC”) policies to prevent financial crimes and, further, you hereby indemnify us with respect to your violations or alleged violations with respect to this Section 4 (Compliance Requirements) of the Attester Terms under Section 13 (Indemnification) of the Terms.

You represent and warrant that your Attester Terms do not violate any of the policies or guidelines set forth by SELF ID in the Terms. If your Attester Terms are inconsistent with SELF ID’s policies or Terms, we reserve the right to suspend or terminate your access to SELF Products.
