The terms and conditions set forth in these Requester Supplemental Terms (“Requester Terms”) are hereby incorporated by reference into the SELF Products Terms and Conditions (“Terms”). In accepting the Terms, you acknowledge and agree that these Requester Terms shall apply to your actions taken, related to, or concerning seeking the User Data of any other User for your own purposes, including business, commercial, or regulatory (each such instance constituting an individual “Request”). Wherein any disclosure by a User of User Data to you takes place pursuant to your Request, you acknowledge and agree that you shall abide by these Requester Terms. Where there is a conflict between the Requester Terms and the Terms, the Requester Terms shall control with respect to the subject matter hereof. Capitalized terms not otherwise defined shall have the meanings given them in the Terms.

1. Data Protection Laws
1.1 Privacy Policy
Where required under applicable law, you shall maintain and provide Users with a copy of your privacy policy in a manner consistent with legal requirements and industry standard practices. You may only process User Data in a manner that complies with applicable laws and is consistent with your privacy policy. You hereby accept full responsibility for your obligations under this Section 1.1 and agree to indemnify, defend, and hold us harmless Self pursuant to Section 13 (Indemnification) of the Terms with respect to your breaches or alleged breaches of this Section 1.1.
1.2 Role of the Requester
For the avoidance of doubt, where any User discloses to you User Data via SELF Products, you are the “controller” under the General Data Protection Regulation (EU) 2016/679 (“GDPR”). You hereby acknowledge and agree that any such disclosure of User Data takes place directly between you and said User. With respect to any such User Data, you and SELF ID are not operating as “joint controllers” as the term is defined in Article 26 of the GDPR and you alone determine the purpose and means of processing. Accordingly, you hereby indemnify us under Section 13 (Indemnification) of the Terms for your breaches or alleged breaches of the GDPR.
2. License
2.1 License granted to you by User
Where a User shares or otherwise discloses a Molecule to you, or any other User Data that received an Attestation, such a Molecule or Attested User Data is governed by those terms and conditions of the issuing Attester. You hereby acknowledge and agree that SELF ID (a) is not responsible for, and has no control over, the terms and conditions of Attesters, and (b) SELF ID is not responsible for, nor do we have any liability with respect to, violations by any User of applicable Attester terms and conditions that affect your use of the subject User’s Molecule. You further acknowledge and agree that your Requester Agreement may be superseded in whole or in part by the issuing Attester’s terms and conditions and it is solely your responsibility to conduct appropriate due diligence prior to submitting a Request to any User. SELF ID is not responsible for the conduct of its Users, whether Third Parties or otherwise, and your Requests are made at your sole risk.
2.2 License enforcement
It is solely your responsibility to ensure that Users from whom you have obtained Molecules or other User Data through any of your Requests comply with your Requester Agreement. You acknowledge and agree that we have no obligation to monitor Users’ behavior with respect to their compliance with your Requester Agreement, nor do we have any obligation regarding any such User’s compliance with your Requester Agreement.
3. Terms of Service
3.1 Responsibility for Terms and Conditions
Throughout the term of your use of SELF Products, you are required to, and solely responsible for, drafting, updating, and maintaining your own terms and conditions that govern the relationship between you and other Users with respect to any Request you submit, services you offer, or products you provide (“Requester Agreement”). Further, your Requester Agreement shall be made available to Users in a manner consistent with industry standard practice and in compliance with applicable law (see Section 4 of these Requester Terms).
3.2 Agreement with Users
By using SELF Products, you agree to enter into a legally binding agreement with each User under your Requester Agreement, which shall govern all transactions, disputes, and relationships with said Users.
3.3 Relationship with SELF ID
SELF ID provides the passive conduit through which you engage with Users, but does not act as a party to any transactions, contracts, or agreements between you and Users with whom you enter into Engagements. You hereby acknowledge that SELF ID has no responsibility for the terms, execution, or enforcement of your Requester Agreement.
3.4 Indemnification
Without limiting any provision of the Terms, you hereby agree to indemnify, defend and hold SELF ID harmless from any claims, damages, losses, or liabilities arising from or related to your Requester Terms.
4. Compliance Requirements
4.1 Generally
As set forth in Section 6 (User Obligations) of the Terms, it is solely your responsibility to ensure compliance with applicable laws and regulations. Further, and without limiting your compliance obligations under applicable laws and regulations, you represent and warrant to us that you have in place the required know-your-business (“KYB”) and know-your-customer (“KYC”) policies to prevent financial crimes and, further, you hereby indemnify us with respect to your violations or alleged violations with respect to this Section 4 (Compliance Requirements) of the Requester Terms under Section 13 (Indemnification) of the Terms.
4.2 SELF Products Terms and Conditions
You represent and warrant that your Attester Terms do not violate any of the policies or guidelines set forth by SELF ID. If your Attester Terms are inconsistent with SELF ID’s policies or Terms, we reserve the right to suspend or terminate your access to SELF Products.
5. User Support
It is entirely your responsibility to provide any support needed for Users who, pursuant to your Request, granted you access to their User Data (including any Molecule(s)) where such a User has questions concerning, or issue related to, such a Request. You hereby agree to adopt a support policy (or equivalent) and make such a policy available to any Users who disclose their User Data to you. For the avoidance of doubt, it shall be our responsibility to assist Users with any technical questions that they may have, or issues that they encounter, with respect to the functionality or features of SELF Products.
6. Security Requirements
It is solely your responsibility and obligation to implement the required physical, technical, and organizational security measures that are commensurate with the nature of the User Data you process. You hereby acknowledge and agree that SELF ID does not, and shall not, have any liability or responsibility for your security policy or practices and you hereby indemnify us under Section 13 (Indemnification) of the Terms with respect to your breach or alleged breach of this Section 6.
7. Financial Obligations
7.1 Amounts due to governments
You, and those Users from whom you obtain any User Data, are responsible for any and all taxes, fees and duties assessed on revenue therefrom by local, state or federal governments. Further, you are solely responsible for the payment of any fines imposed by any regulatory agency pursuant to any Request. We are not responsible for the payment of any such taxes, fees, duties imposed on your, or any User from whom you obtain User Data, income or profits and you hereby agree to indemnify us under Section 13 (Indemnification) of the Terms with respect to your breach or alleged breach of this Section 7.1.
7.2 Amounts due to Users
You hereby acknowledge that you are solely responsible for the payment of any amount(s) owed to any User(s) based upon your submitted Requests. Any amount(s) to be paid pursuant to your Request(s) are set solely by you and the subject User(s) to the Request transaction. For clarity, SELF ID plays no role in, nor do we have any responsibility or liability with respect to, the setting of any amount(s) to be paid with respect to your Request(s). Wherein any dispute arises between you and any User regarding amount(s) owed under any of your Requests, you hereby indemnify us under Section 13 (Indemnification) of the Terms.
